Are you leaving a portion of your estate to the IRS? You may have unintentionally included Uncle Sam in your list of heirs. It is important to sit down with an attorney competent in estate administration and estate tax issues to plan your estate distribution. Without doing this, you may be maximizing the tax bill your heirs will have to pay and adding to their frustration in their time of sorrow.

There are many common mistakes that could be easily and inexpensively avoided simply by hiring an attorney well versed in probate and tax law. Without a will, it may be necessary for the probate court to appoint an attorney ad litem to search for any additional heirs (unknown children), adding additional expense and delays to settling your estate. Likewise, without a will, you and your spouse may not be able to take advantage of some planning that could reduce Uncle Sam's tax bite out of your estate.
