If you owe someone money, you often feel they own you. When financial difficulties arise, a creditor or a debt collector may make your life miserable. They harass you. They take your property. They threaten you. In these trying times, you may have rights to stop some of the harassment. Too many people wait too late to protect their rights. You must act early to preserve your rights.

CREDITOR OR DEBT COLLECTOR HARRASSMENT

Predatory creditors and third party debt collectors often employ an arsenal of harassing conduct to try to force a person to pay. They call at all hours of the night. They demand that you pay by a post dated check. They threaten to file criminal charges or have you arrested if you do not pay. They threaten to take your paycheck (called wage garnishment). The law limits what a creditor or a debt collector may do to collect a debt. If they are violating the law, an attorney can help you seek protection from this harassing behavior.

If your creditor has turned your account over to a collection agency, you have additional rights. Debt collection agencies may not contact you directly if you are represented by an attorney. Merely hiring an attorney stops debt collector calls from collection agencies. If your account has not been turned over to a collection agency, you have some rights, but not as many as you would against a collection agency.

ILLEGAL CONTRACTS OR LOANS

The law imposes certain requirements on lenders. For example, the law limits the amount of interest that a lender may charge. If you are concerned that your lender has violated the law, you should talk to an attorney to see if you can force your lender to follow the law.

REPOSSESSIONS AND FORECLOSURES

The law imposes certain requirements on lenders who try to repossess your property or foreclose your home or other real property. If your home or business property has been posted for foreclosure, or your personal property has been seized or repossessed, you should talk to an attorney to protect your rights. In certain circumstances, courts can stop a foreclosure sale or order a lender to return property wrongfully repossessed. Delay often wipes out your rights. It is important to contact a lawyer immediately.
